Restaurant / food-facility permit

Public Food Service Establishment license (DBPR, by seating)
By seating (DBPR statewide): Nonseating $242/yr; 1-49 seats $262; 50-149 seats $273 (higher tiers above). A $50 new-application fee applies. Caterer license $263/yr.

State-administered, not county. Restaurants and other public food service establishments are licensed by the Florida Department of Business & Professional Regulation (DBPR), Division of Hotels & Restaurants. Fees are identical in every Florida county. The Florida Department of Health - Manatee County does NOT license restaurants.

Plan review — required

Food truck / mobile permit

Mobile Food Dispensing Vehicle (MFDV) license (DBPR)
$347/yr ($178.50 half-year) plus $50 application - DBPR Mobile Food Dispensing Vehicle. Packaged-food-only mobile vendors are licensed by FDACS (Mobile Vendor ~$300).

Prepared-food trucks/carts are DBPR MFDVs; carts selling only packaged/grocery items are FDACS. A commissary/base that reports the vehicle is required. Florida law (state preemption) limits additional local regulation of MFDVs.

Watch out for

  • State-administered split authority - restaurants/food service = FL DBPR; groceries, supermarkets, convenience stores, bakeries and food processing = FDACS Division of Food Safety.
  • DBPR public food service establishment fees are set statewide by seating tier (Nonseating $242 up through larger seating tiers); Caterer $263.
  • FDACS retail food fees: Retail Bakery $355; Retail Bakery with food service $440; Wholesale Bakery $465; Grocery Store $465; Supermarket $500 (statutory cap $650, Ch. 500.12 F.S.).
  • Temporary food service events are licensed by DBPR: $91 (1-3 day event) / $105 (4-30 day event); annual temporary food service vendor $456.
  • The Florida Department of Health-Manatee County conducts some public-health inspections but does NOT issue restaurant or grocery licenses (that is DBPR / FDACS).
