MAJOR RECENT CHANGE - the Food Truck Freedom Act. Effective 2025-11-01, HB 1076 and HB 2459 mean any vendor holding an OSDH food establishment licence may operate in ANY local jurisdiction in the state, and LOCAL AUTHORITIES ARE REQUIRED TO RECOGNISE IT. A local authority may still issue its own permit but may charge NO MORE than its administrative cost. EXCEPTION: to operate in Tulsa County or Oklahoma County you must hold a licence from a local authority within those counties - and that county licence is then recognised by OSDH and every other local authority statewide. ZONING RULES WERE ALSO CLARIFIED: with the property owner's permission you may operate in any zoning district that allows food service establishments, and with a RESIDENT's permission you may operate in a RESIDENTIAL district for up to 12 days per year. State Parks require a contract or lease with the Oklahoma Tourism and Recreation Commission. Ten days' notice to OSDH and local authorities is required before serving at a temporary mass gathering, and visible customer waste receptacles are mandatory. Definition: prepares food, DOT road-approved with wheels and axles, readily moveable, remains at one physical address no more than 12 hours at a time. Signage: business name and OSDH licence number on the exterior in letters at least 3 inches, during operating hours. Commissary required as base of operations and must be listed on the plan review. Plan review precedes construction and licensure; prepackaged-only retail units pay no plan review fee. FIRE: since 2025-11-01 a State Fire Marshal inspection and decal are required, and from 2026-01-01 suppression is required for appliances producing or capable of producing smoke or grease-laden vapour; prepackaged-only trucks exempt.
